Welcome to Vidzers.com (“Vidzers”, “we”, “us”, or “our”), an influencer marketing platform that connects digital marketers with influencers to facilitate marketing campaigns. By accessing or using Vidzers.com, you (“User”, “you”, “your”) agree to comply with and be bound by the following Terms of Service. These Terms govern your access to and use of the platform and its services, whether as a digital marketer or influencer. Please read them carefully.

1. Acceptance of Terms

By registering for an account or using any part of the Vidzers platform, you agree to be bound by these Terms of Service and any policies referenced herein. If you do not agree to these terms, you may not use the platform.

2. Description of Services

Vidzers provides an online platform that allows:

• Influencers to build a content portfolio by integrating content from social media platforms (e.g., YouTube, Instagram, TikTok, Facebook) and showcase their performance metrics. This is facilitated using APIs authorized by the influencer.
• Digital marketers to find and collaborate with influencers for influencer marketing campaigns.

2.1 Influencers

• Influencers may join the platform for free and showcase their social media content through the platform’s portfolio feature.
• Vidzers uses authorized API connections to pull performance statistics and video content from the influencer’s social media profiles.
• Influencers may apply for campaigns published by digital marketers.
• Value-added services may be purchased by influencers at additional fees.

2.2 Digital Marketers

• Digital marketers can subscribe to various plans offered by Vidzers to access the platform.
• Upon registration, digital marketers are required to provide company details such as company name, address, website URL, and logo. This information will be used to create a profile visible to influencers.
• Digital marketers can publish campaigns such as banner advertisements, picture-in-picture advertisements, and paid promotions.
• Vidzers will recommend suitable influencers for campaigns based on factors like follower count, content subject, and budget.
• Digital marketers will be able to view and shortlist influencers based on their subscription plan limits.

3. Account Registration and Obligations

To use the Vidzers platform, you must register for an account and provide accurate, complete, and up-to-date information.

3.1 Influencers

• You must provide authorization for Vidzers to access and display your social media content and performance data.
• You agree that the content and data provided are accurate and not misleading.
• You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3.2 Digital Marketers

• You must provide accurate company information during the registration process.
• You are responsible for maintaining the confidentiality of your account information and all activities that occur under your account.
• You must ensure that any content you upload (e.g., digital creatives for campaigns) adheres to the prescribed format and is lawful.

4. Platform Features

4.1 Campaign Publishing (Digital Marketers)

Digital marketers may publish influencer marketing campaigns on the platform, which can include:

• Banner advertisements
• Picture-in-picture advertisements
• Paid promotions

Digital marketers must upload digital creatives for banner and picture-in-picture advertisements in formats specified by Vidzers.

4.2 Influencer Matching (Vidzers)

Vidzers uses algorithms to match digital marketers with influencers based on subscriber or follower count, content subject, budget, and other criteria. Vidzers will notify influencers of relevant marketing opportunities via notifications, email, SMS, and/or WhatsApp.

4.3 Campaign Application (Influencers)

Influencers may review and apply for campaigns they are interested in. Once an application is submitted, digital marketers can view the influencer’s profile and choose to shortlist them for further collaboration.

4.4 Shortlisting and Negotiation (Digital Marketers)

The number of influencers a digital marketer can shortlist depends on their subscription plan. Once influencers are shortlisted, Vidzers enables both parties to interact and negotiate the terms of engagement, including payment.

5. Payment and Fees

5.1 Influencers

Influencers can use Vidzers for free but may access value-added services at additional fees. Payment for campaigns, if agreed upon with a digital marketer, will be facilitated through direct negotiation between both parties. Vidzers is not responsible for any payment terms agreed upon.

5.2 Digital Marketers

Digital marketers must subscribe to one of the available plans to access platform services. Subscription fees vary by plan and provide different levels of access to influencers and campaign management tools. Payments made for subscription services are non-refundable unless otherwise stated in Vidzers’ refund policy.

6. User Conduct

6.1 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Misrepresenting your identity or affiliation with any individual or organization.
• Using the platform for any unlawful or fraudulent purpose.
• Uploading any content that infringes on any intellectual property rights, privacy rights, or other legal rights of third parties.
• Manipulating or interfering with the proper functioning of the platform, including uploading viruses or harmful code.

7. Intellectual Property

All content on Vidzers, including but not limited to text, graphics, logos, and software, is the intellectual property of Vidzers or its licensors. You may not reproduce, modify, distribute, or exploit any of the platform’s content without prior written permission.

8. Third-Party Services

The platform may contain links to third-party websites or services. Vidzers is not responsible for the content, privacy policies, or practices of third-party websites. Use of third-party services is at your own risk.

9. Termination

Vidzers reserves the right to terminate or suspend your account at its sole discretion, with or without notice, if you violate these Terms of Service or engage in any activity that may harm the platform or its users.

10. Disclaimers and Limitation of Liability

Vidzers does not guarantee the success of any marketing campaigns or the suitability of influencers or digital marketers. The platform is provided on an “as is” and “as available” basis without warranties of any kind. Vidzers will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of [Your Country]. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Kochi, Kerala, India.

12. Amendments
